  • Climate Change: What’s Driving us Crazy?

    Down to Earth: Politics in the New Climactic Regime (2018) by the recently deceased French philosopher Bruno Latour points to a conspiracy theory perpetrated by elites since the 1970s to conceal the true nature of climate change.

    Latour argues the intervening period, associated with Ronald Reagan and Margaret Thatcher, ‘was initially marked by what is called “deregulation”, alongside ‘the start of an increasingly vertiginous explosion of inequalities.’

    This coincided, he says, with another phenomenon less often stressed: ‘the beginning of a systematic effort to deny the existence of climate change’. He defines “climate change” in broad terms as ‘the relations between human beings and the material conditions of their lives,’ rather than simply the climatic consequences of anthropogenic greenhouse gases, as the contemporary environmental challenge is commonly reduced to.

    This broader definition of “climate change” therefore encompasses ecological constraints – the material conditions of our lives – which even the most vociferous denier cannot gainsay, as well as other readily ascertainable phenomena such as pollution and nature loss.

    Latour continues, ‘It is as though a significant segment of the ruling classes (known today rather loosely as “the elites”) had concluded that the earth no longer had room enough for them and for everyone.’

    He contends: ‘they [“the elites”] decided that it was pointless to act as though history were going to continue to move toward a common horizon, toward a world in which all humans could prosper equally.’

    Thus, ‘From the 1980s on the ruling classes stopped purporting to lead and began instead to shelter themselves from the world. We are experiencing all the consequences of this flight, of which Donald Trump is merely a symbol, one among others.’

    He offers the stark conclusion that any observer of social media can attest to: ‘The absence of a common world we can share is driving us crazy.

    Dominant players in the fossil fuel industry were undoubtedly aware of climate change by the late 1970s, and developed communication strategies designed to confound the public. Through their risk analyses, leading investment banks – representing the real elites – would surely have been privy to such information that had been circulating since the 1960s.

    Latour is correct to assert that since the 1970s inequalities have spiralled to the advantage of these elite ruling classes. However, his book fails to anticipate how canny operators among the elites – while preparing boltholes in remote locations – shifted approach on climate change

    Rather than ignoring what had emerged as a scientific consensus on the need to find alternatives to the extraction and use of fossil fuels, elites recognised mouth-watering opportunities for further wealth accumulation from renewable energy.

    Thus, investment portfolios were diversified, and bets hedged. It hardly mattered that technologies branded “clean and green” could still have devastating environmental impacts, or lead to new relationships of dependency in developing countries. In this re-alignment, companies create halo effects around products through greenwashing strategies. This explains the unprecedented attention to climate change we now see across mainstream media.

    The belated embrace of environmentalism – once the preserve of hippies – by elites also distracts from the urgent need for structural adjustments.

    The delusion of elite-led reform is sustained by a compromised and sycophantic media, reminiscent of the fawning courtiers of unaccountable monarchs. But all the indicators are that reforms will be cosmetic, as successive emission reduction targets are not met.

    Lacking “a common world”, where resources and opportunities are shared equitably within countries and internationally, populists may point to the hypocrisy of a system that permits “vertiginous” inequalities. Under private ownership, transitioning from fossil fuels to renewables yields profits for the elites, but may impoverish many who are already living on the edge.

    Since Latour’s book, much abides, but much has changed too. The apparent “symbol” of our collective madness, Donald Trump, lost the 2020 Presidential election, while other populist leaders such as Jair Bolsonaro and Boris Johnson have also exited stage right, for the time being at least. But inequalities only increased during the pandemic, when trust in science was undermined by profiteering.

    The ongoing war between Russia and Ukraine, alongside simmering US-Chinese tensions over Taiwan, indicate the era of globalisation has come to an end. In this new edition of the Cold War, conservative, authoritarian leaders are pitted against Western governments dominated by elites that appear to be profiting from another crisis.

    Environmentalists ought to recognise that we are facing a nuclear winter, worse even than the impact of climate change, if the Ukrainian-Russian conflict escalates, and support attempts to broker a negotiated settlement. Moving forward, a new global compact is urgently required to address environmental challenges and rampant inequality.

    The environmental movement should develop a more nuanced understanding of the social and political forces ranged against meaningful reforms in the West. To develop, as Latour puts it a “common horizon” – and overcome collective madness – in the face of climate change and inequality, democratic governments must act to reverse the deregulation that occurred in the 1980s, and in particular assert control over a highly profitable renewable energy sector.

  • Review: Notes from an Apocalypse

    ‘We are alive in a time of worst-case scenarios. The world we have inherited seems exhausted, destined for an absolute and final unravelling’. So begins Mark O’Connell’s journey into our ever-darkening future.

    There are, he notes darkly, fascists in the streets and in the palaces, while around us ‘the weather has gone uncanny, volatile, malevolent’. The last remaining truth, O’Connell proposes, ‘is the supreme fiction of money, and we are up to our necks in a rising sludge of decomposing facts. For those who wish to read them, and for those who do not, the cryptic but insistent signs of apocalypse are all around’.

    The faint splattering sound that reechoes throughout ‘Notes from an Apocalypse’ is that of the shit hitting the metaphorical fan.

    ‘Listen. Attune your ear to the general discord, and you will hear the cracking of the ice caps, the rising of the waters, the sinister whisper of the near future. Is it not a terrible time to be having children, and therefore, in the end, to be alive?’, O’Connell muses.

    Familiar Journey

    The journey is a familiar one, in every sense. My mind flows back to early 2003, my first-born still an infant then, her future an unknown country. Out of the fog of broken sleep and newfound joys and terrors, I began, for the first time in my adult life, to look into the future. Not days and weeks, but years and decades.

    What I found staring back was every bit as chilling as O’Connell’s more recent epiphany, and it has, to a lesser or greater degree, haunted my waking hours every day since then. As he points out, once you’ve become a parent, ‘whether it happens by choice or by chance, is that it is one of only very few events in life that are entirely irreversible. Once you’re in, existentially speaking, you’re in’.

    This being the case, the next question effectively writes itself: How are we supposed to live, ‘given the distinct possibility that our species, our civilization, might already be doomed?’ While he may have lost hope, O’Connell certainly hasn’t lost his dark sense of humour, describing the curious feeling of being sick to death of the end of days. ‘I’m sick, in particular, of climate change. Is it possible to be terrified and bored at the same time?’, he wonders aloud.

    Back in the good old days of the Cold War, the spectre of global annihilation was never far away. And while the risks were all-too-real, in reality it was always a binary proposition: either we would have a total nuclear war or nothing at all would happen. And, with luck, cooler heads would prevail and catastrophe would be avoided.

    O’Connell notes that we civilians were pleasantly blameless, either way, mere bystanders ‘whose role was limited to cowering in terror, maybe holding the occasional placard, partaking here and there in a chant if called upon to do so’. In classical eschatology, the apocalypse, whether religious or secular, would be delivered in a blinding thunderbolt, ‘a sudden intercession of divine or technological power’.

    The very real doom that encircles us is altogether more banal, more insidious and one in which we are both helpless bystanders and active, albeit unwitting, participants. To be alive today, to live in a prosperous modern society is to be an integral part of the very linear system of consumption, expansion and disposal that is fast destroying the natural world and the very basis for our current prosperity and all future prospects for every generation that succeeds us.

    Footprint

    O’Connell acknowledges the thin irony that his own gloomy travelogue entailed vast emissions of the very carbon that is burning down the world. ‘My footprint is as broad and deep and indelible as my guilt… I myself am the apocalypse of which I speak. That is the prophesy of this book’.

    That ‘Notes from an Apocalypse’ should be published in the midst of the first global pandemic of the Internet Age seems grimly apposite, life in imitation of art as the confident certainties of our world unravel in unpredictable, non-linear ways.

    O’Connell vividly describes his growing obsession with the imminent collapse of civilisation. He sees himself as being obsessed with the future, ‘an obsession that manifested as an inability to conceive of there being any kind of future at all…my journalistic objectivity, a fragile edifice to begin with, was under considerable strain’, he adds.

    Many people seek to escape their demons. In this trade, that’s not so easy. ‘It is both a privilege and a curse of being a writer that throwing yourself into your work so often involves immersing yourself deeper into the exact anxieties and obsessions other people throw themselves into their work to avoid’.

    The book, O’Connell accepts, probably was initially conceived as a form of therapy, though he admits to what he calls a more perverse motivation: ‘I was anxious about the apocalyptic tenor of our time, it is true, but I was also intrigued. These were dark days, no question, but they were also interesting ones: wildly and inexorably interesting. I was drawn toward the thing that frightened me, the thing that threatened to tear everything apart, myself included’.

    This gave him the impetus to embark on a series of what he describes as perverse pilgrimages ‘to those places where the shadows of the future fall most darkly across the present’. Nor is the overtly religious framing accidental. ‘If I could be said to have had a faith in those days, it was anxiety—the faith in the uncertainty and darkness of the future’.

    O’Connell’s research took him into many dark places; he describes being unable to click on links in his computer’s browser ‘for fear that what I gained in knowledge I would lose in sanity—my online existence was saturated in a sense of end-time urgency’.

    In other circumstances you could reasonably infer that the author was in reality experiencing what is for all intents clinical depression, the key difference being that the auguries of catastrophe which he was consulting are not the product of his fevered imagination, but are a painfully accurate reflection of the world as it stands.

    ‘Preppers’

    Avoiding the sensible options of pouring his energies into what might be seen as more constructive channels, O’Connell ‘set out towards the darkness itself’. And where better to start than with the weird US sub-culture called ‘preppers’. This group consists almost exclusively of middle aged and older white males with an unnatural interest in dried food, assault rifles and racism.

    O’Connell is merciless in his depiction: ‘as a group, preppers were involved in the ongoing maintenance of a shared escapist fantasy about the return to an imagined version of the American frontier—to an ideal of the rugged and self-reliant white man, providing for himself and his family, surviving against the odds in a hostile wilderness’.

    In seeking to rekindle some imaginary frontier spirit, what preppers are in fact doing, he adds, is ‘creating the necessary conditions for a return to the cleansing violence of the nation’s colonial past … In fact, you couldn’t even properly call it crypto-fascism: it was really just good old-fashioned original-style fascism’. The National Geographic’s TV channel ran a series for three years called Doomsday Preppers; O’Connell gorged on many hours of it on YouTube as part of his research. While ostensibly about gearing up for post-apocalyptic survival, he believes the show ‘is in fact a reality TV psychodrama about masculinity in crisis’.

    Preppers, he concludes, ‘are not preparing for their fears: they are preparing for their fantasies. The collapse of civilization means a return to modes of masculinity our culture no longer has much use for’.

    While disagreeing with them in almost every regard, O’Connell admits to relating to the ‘distributed matrix of unease from which the certainty of collapse grew. I, too, with my pessimism, my intimate imagination of the world’s unravelling, had driven my own wife, if not to despair itself, then to somewhere in its vast and crumbling exurbs’.

    I can certainly attest to the strain that burdening yourself with documenting the slow, agonising death of the world imposes both on you as an individual and on your long-suffering spouse and family.

    O’Connell’s perverse pilgrimage takes him to the wilds of South Dakota where, for a price, you can buy a bunker with all the mod cons. This bug-out fantasy is being marketed and sold with the characteristic exuberance of the U.S. real estate industry. ‘This was a new entry into the apocalyptic imaginary: bankers and hedge-fund managers, tanned and relaxed, taking the collapse of civilization as an opportunity to spend some time on the links, while a heavily armed private police force roamed the perimeters in search of intruders. All of this was a logical extension of the gated community. It was a logical extension of capitalism itself’.

    At its cold heart, this amounts to the haves battening down the hatches against the have-nots, unequal to the bitter end. Unlike the old anti-nuclear war slogan, it appears that all men will not in fact be cremated equal. And nowhere is this inequality more apparent than in New Zealand, now the world’s favourite end-of-the-world bolthole for the excessively rich.

    ‘Everyone was always saying these days that it was easier to imagine the end of the world than the end of capitalism. Everyone was always saying it, in my view, because it was obviously true’, O’Connell continues. ‘The perception, paranoid or otherwise, that billionaires were preparing for a coming collapse seemed a literal manifestation of this axiom. Those who were saved, in the end, would be those who could afford the premium of salvation’.

    Backup Planet

    Next, O’Connell tagged along with the space colonisation enthusiasts, most notably oddball billionaire Elon Musk, who described Mars as our ‘backup planet…just in case something goes wrong with Earth’. Similar to doomsday preppers with their bags of dried food, ‘Mars colonisation is apocalyptic scenario as escapist fantasy’.

    What he describes as a narrative of exit is, O’Connell argues, fundamentally male, a yearning for escape ‘as a means towards the nobility of self-determination’. The world, our world, urgently needs attention, care, rehabilitation, yet the ultra-rich techno-fantasists are instead writing it off, dreaming of new empty spaces to subjugate, to colonise, to shape in their image, without state or societal oversight, a darkly Utopian fantasy played out on the blank canvas of the cosmos.

    ‘The politics of exit are pursued, according to cultural critic Sarah Sharma at the expense of a politics of care. ‘Care, she writes, is that which responds to the uncompromisingly tethered nature of human dependency and the contingency of life, the mutual precariousness of the human condition’. To repudiate the Earth is to reject the imperative of care.

    It goes without saying that the escapist daydreams of the wealthy elites envisage salvation only for the tiny handful; the mass of humanity will, it seems, be consigned to burn, fight and starve amid the smouldering wreckage of a plundered biosphere that has been asset-stripped to the bone.

    The intuition that many of the global 0.001 percenters actually seriously believe this stuff makes sense of a circle I have long struggled to square: how can tycoons and titans so blithely ignore the ever-encroaching ecological consequences of the profitable destruction they are orchestrating? Surely they too have kids, they must ultimately breathe the same air and drink the same water as the rest of us? Well, apparently not.

    The colonial mindset that saw groups of determined Europeans and later, Americans, set out to conquer, subdue and enslave every country on Earth they encountered that was incapable of fighting them off is alive and well, and the age of gunboat colonialism has been replaced by the more subtle but equally effective economic colonialism.

    East India Company

    Today, as before, ultra-cheap goods, minerals and raw materials flood out of the global South through trade channels controlled by powerful transnational corporations whose monopolies are operated every bit as ruthlessly as the East India Company, which enjoyed a royal charter giving it permission to ‘wage war’ and, at its peak, had its own army numbering 260,000 troops, twice the size of the then British army.

    The rape, pillage and plunder of the Earth has as a project been underway in earnest for centuries, but it is those of us alive in the 21st century and without tickets to Mars, who are about to reap the whirlwind.

    As O’Connell notes, capitalism, ‘which exists and thrives through expansion of its own frontiers, through a relentless force of deterritorialization, is running out of frontiers; running out of boundaries to obliterate, nature to exploit’. The legacy of what he terms its monomaniacal pursuit of cheap resources is a ‘devastated planet that soon may be unliveable for vast numbers of its inhabitants’.

    Just quite how soon and for just how many was to become clearer even as I was reading ‘Notes from an Apocalypse’. It came in the publication of a new peer-reviewed study using data from UN population projections and a 3ºC global warming scenario in line with current scientific projections.

    While we think of ourselves as a highly adaptable species, filling niches from the high Arctic to the tropical jungles, in reality, most human populations are concentrated into narrow ‘climate bands’ in areas where the average surface temperature is in the range of 11–15ºC.

    An average global surface temperature rise of 3ºC in the coming decades would leave some three billion people in areas with average temperatures as hot as the Sahara desert is today. Wide tracts of India, Australia, Africa, South America and the Middle East will, in just a matter of decades, be essentially uninhabitable for humans and most animals.

    Consider the impact of 2-3 million refugees fleeing the aftermath of conflict in the Middle East and how the impact of these desperate migrants strained the EU almost to breaking point. Now, multiply that not by 100, but by 1,000 and suddenly the idea of escaping to establish a colony on a barren neighbouring planet no longer seems quite so insane.

    Back on planet Earth, the Arctic is burning. ‘That there were wildfires in the Arctic Circle felt like the most important fact in the world. This was a thing we should never not be thinking about, talking about… the subtext of every news headline now, of every push notification, was that we were completely and irrevocably fucked’.

    An Island Apart?

    O’Connell, who is Dublin-based, recalls sharing office space with an ecologist, who told him people often ask her how Ireland will fare with climate change. Overall, and relative to so many other countries, actually pretty well, is the short, but entirely incomplete answer.

    ‘What would it even mean, after all, to be fine in the context of a drowning world, a world on fire? We were a small island, with nine hundred miles of coastline and an army that would by itself be effectively useless against any kind of invasion. We would be relying, she said, on the goodwill of other countries whose people were starving, drowning, burning. We would not be fine’.

    O’Connell’s meditation returns time and again to his own son, from whom he feels he is keeping a secret. ‘Just as I want him to continue believing in Santa Claus for as long as possible, I want to defer the knowledge that he has been born into a dying world. I want to ward it off like a malediction’.

    He outlines the complex denialism both he and his wife engage in to shelter their son and his newly born sister from true knowledge of the world as it is. ‘There are times when it seems that we are protecting him, and protecting ourselves, from a much deeper and more troubling truth: that the world is no place for a child, no place to have taken an innocent person against their will’.

    O’Connell strikes a universal chord by observing that becoming a parent means having a radically increased stake in the future. Being responsible for a person who must live in the place and time normally inhabited only by your deepest fears means ‘I no longer feel the definitive force of pessimism as a philosophy…life no longer seems to afford me the luxury of submitting to the comfort of despair’.

    In what may be a rich irony, O’Connell professes to having lost his taste for cosmic nihilism: ‘Lately I have been glad to be alive in this time, if only because there is no other time in which it’s possible to be alive’.

    While it might seem glib in the extreme to be seeking out teachable moments from the imminent collapse of the biosphere and the extirpation of our species among countless others, what does perhaps emerge from his journey is a deeper, visceral understanding of what it truly means to have been alive in the first place.

  • Predictions 2020: 5G Rollout, Trump Card & Reuters Report

    Five predictions for 2020: The Trump Card, an analysis of the Reuters Institute Digital News Report 2019, CES 2020, implications of 5G rollout and a Republican climate change pivot.

    The Trump Card

    For all the talk of a fading U.S. Superpower since President Trump came to office, there is one statistic firmly in his favor. The U.S. remains the world’s most powerful global economy in absolute terms, and home to the largest stock market.

    In truth, economic indicators have rarely looked better. Corporate taxes have been cut and red tape slashed. As a result, the stock market has surged to an all-time high[i] and unemployment is hovering at levels last seen in 1969.[ii] Sure there is still serious inequality, and poverty, but at least there are employment opportunities for those willing to work.

    The big question for 2020, then, is whether the bull market continues. As ever, we’re feeling Bullish, but not as much about the political ramifications.

    Whatever the latest polls are saying in the wake of the Impeachment, when the economy is in this state, it’s hard to see an incumbent President losing an election.

    Over the course of 2020 we anticipate billions of dollars being spent on influencing the American electorate which way to vote. All of this will be keenly watched by a global audience, who are aware that where the U.S. travels, others follow.

    The outcome has a sense of inevitability, hinging as it does on the health of the stock market. As Bill Clinton, another President who faced Impeachment, famously said: ‘it’s the economy, stupid!’, and this still holds true. Barring a dramatic stock market crash, or a natural disaster, Trump is going to be re-elected.

    Patriot Act

    In the event of the stock market crashing, Bull Moose predicts Trump will wrap himself tightly in the star-spangled banner, much in the way his one-time mentor Roy Cohn did whenever he faced trouble.

    The big question is whether appealing to patriotism will be enough to save him. After all, this approach can be replicated by the Democratic opposition, even if Republicans have owned the story in recent times.

    Enter another iron law of U.S. politics: whenever the nation is involved in a military conflict, Presidents don’t lose elections.

    Much in the same way as other ‘strongman’ leaders have done – Tayyip Erdogan, Vladimir Putin and Kim-Jong Un spring to mind – Trump is likely to develop a rallying cry, awakening fears of an external threat beyond anything the Democrats are serving up to him – just like the Bush administration used the War on Terror to galvanise its base.

    He’s sure to deploy the usual rhetoric about the dangers of socialism and the ‘woke’ left, epitomized by ‘The Squad’, a group of four Congresswomen (Alexandria Ocasio-Cortez of New York, Ilhan Omar of Minnesota, Ayanna Pressley of Massachusetts, and Rashida Tlaib of Michigan), all from so-called ‘minority’ backgrounds. But against a more centrist Democrat candidate, such as Joe Biden, this might not prove to be enough. Trump needs a scarier prospect, an enemy to make mainstream Democrats quake.

    Alexandria Ocascio-Cortez

    The drone-strike assassination of Qassem Soleimani on January 3rd was aimed at a domestic audience as much the Iranian regime. Much remains to be said, but henceforth every decision taken by this President should be viewed in the context of a single-minded preoccupation: to win re-election for another term.

    Reuters Report

    Hot off the press, The Reuters Institute Digital News Report[iii] makes for interesting reading about the state of news journalism in the world. Perhaps the most important takeaway is this:

    There is no sign that the majority of people are about to pay for online news, although many recognise that information on the internet is often overwhelming and confusing. Younger audiences in particular don’t want to give up instant, frictionless (and ideally free) access to a range of diverse voices and opinions. They don’t want to go back to how the media used to be.

    The global media landscape has changed forever. There is no going back.

    Specific to the United States, the report reflects our view that ‘audiences remain deeply polarised, much more so than most other countries.’ This reflects what we said back in July: ‘Among the least discussed, but perhaps most important influence of the Digital Age is our tendency to live in bubbles. We no longer have to be rich to live in the equivalent of gated communities.’ A near total absence of communication between the two sides is a clear and present danger to democracy itself.

    It should also be noted that many media organisations are still struggling hugely in the digital era, despite the rosy economic picture overall. Nonetheless, a few leading companies continue to do well, in effect consolidating their market dominance – think Washington Post, New York Times & Fox News.

    The report points to jobs cuts affecting a variety of lesser publications, from the venerable Cleveland Plain-Dealer to digital-platform First Look Media. Notably, in January 2019, BuzzFeed laid off 15% of its worldwide workforce (a total of 220 positions). That very week Verizon Media Group, which owns HuffPost, announced a 7% reduction across its media properties, totalling about 800 positions. Gannett, the leading U.S. news publisher, also announced layoffs at local newspapers across the country.

    The Report says this is ‘stoking continued concerns about the future of local news,’ although perhaps more reassuringly viewership on local television news has remained steady.

    Podcasts are bucking the downward trend, however, with the U.S. leading the world in listenership, including daily news-focused offerings. The New York Times’ ‘The Daily’ began broadcasting in 2017 and now averages 1.75 million daily downloads. It is joined by the Washington Post’s ‘Post Reports’, Vox’s ‘Today Explained’, Slate’s ‘What Next’, ABC News‘Start Here’, among others. Another notable development is VICE News partnering with Spotify to produce the bilingual podcast series ‘Chapo.’

    While these may seem like the usual suspects, a host of small players are also succeeding in this space. This trend is likely to continue in 2020, increasing the depth and breadth of coverage around the world and inviting people to step outside their news media bubbles. This bodes well for micro-operators, such as the Joe Rogan podcast and our own Cassandra Voices, that offer fresh angles.

    CES 2020

    January is the time of year that for the great and the good to gather in Vegas for CES 2020 and discover the latest news and hands-on reviews from the world’s biggest tech show.[iv]  Well over 200,000 people attended this year’s event, providing a useful bellwether on where the digital economy is headed in the years to come.

    Amid heightened concerns about infringements on personal data, the headline panel featured representatives from Google, Amazon, Facebook and Apple, to discuss privacy.

    Alarm bells should be ringing that measures are being taken by the conglomerates themselves, rather than restraints being imposed on them by democratically elected representatives. While most Americans are interested in protecting their privacy, an unspoken consensus seems to have developed, where convenience is the trade-off for the loss of personal data. The question is how long the truce will last, before consumers start to object to being told what they desire.

    Bull Moose had some cause for concern himself over the holidays after being surprised to receive a data usage warning from his latest model Galaxy smartphone – unusually all 64GB of storage had been used up. On top of all that, the photo and video file cache was empty.

    Facing a choice between asking his young nephew to figure out how to delete the files, Bull Moose plugged the phone into his computer to explore what was happening. Lo and behold, he came across a cache of external sites that had been collecting data on the phone’s activities – involving all manner of companies and apps.

    Collectively, these were using 32GB of storage, and after deleting these nothing was lost in terms of functionality. Presumably this data was there for companies to access relevant information at their time of choosing.

    Let’s be clear, the primary reason data is collected is to allow companies to profile you in order to sell you goods and services, which they believe you will want.

    On the surface, a limited amount of this is ok –  advertising is often a bit of a shot in the dark after all – and people are ultimately free to make up their own minds. It’s just about fine provided there is government oversight to prevent identity theft or malicious use of data. The problem is there isn’t any.

    It’s only really the relatively toothless and tedious GDPR, enacted by the E.U. in 2018, and California’s new Consumer Privacy Act[v] that are attempting to curb the data free-for-all.

    The Rise of 5G

    Enter 5G technology, which is likely to alter the way our societies interact with technology. 5G-enabled technologies and networks are characterized by delivery of ultra-high-speed bandwidth, ultra-low latency, and ultra-high reliability of service. It is believed this will lead to connection speeds up to one hundred times faster than we are used to. But it will also generate greater possibilities for tracking and data collection.

    At CES 2020, 5G was very much in focus. Wired magazine had this to say:

    CES 2020, then, will be an opportunity for tech makers to demonstrate that 5G will be an actual thing this year, and they’re not going to hold back. Some of these announcements will be around specific devices, like Dell’s 5G-ready Latitude laptop. Others will be around chipsets: MediaTek, for example, plans to roll out a premium 5G chipset for phones at CES, and Qualcomm will likely expound upon the announcements it made at its annual Hawaii summit back in December. Most importantly, expect infrastructure updates, as the US carriers continue to expand their 5G networks and show off how the fifth-generation of wireless will transform healthcare, “smart” cities, and autonomous vehicles.[vi]

    While most consumers view 5G much like the arrival of 3G or 4G, i.e. as just another smartphone upgrade, in fact it will have a transformative impact on the technology we use ever more in our daily lives.

    Besides privacy questions and public health issues (5G requires a great number and more integrated cell-phone towers), there are also concern around China’s, and specifically Huawei’s, lead in this new technology. As Linsday Gorman in the Atlantic puts it:

    Policymakers on both sides of the Atlantic, from European economics ministers to President Donald Trump, have viewed the 5G dispute first as a trade issue … the West has ample reason for caution about Chinese 5G suppliers. For one, the recent Chinese National Intelligence Law requires these companies to comply with Communist Party demands to turn over data or otherwise engage in snooping or network-disruption activities.

    … recent revelations about how China’s ruling party exploits the full panoply of personal information it has amassed about its citizens—facial-recognition images, mandatory DNA samples, 24-hour GPS coordinates, and search-history and online-activity tracking, as well as plain old eavesdropping—to quash religious freedom and basic rights should give major pause to Western governments and wireless carriers alike.[vii]

    Taken together – trade, security, changing interaction with technology, tracking and personal health –  the issues that came to the fore around 5G in 2019 seem likely to gain traction.

    Five Predictions for 2020

    1. The stock market run will finally come to an end, forcing President Trump to play his remaining card. Military involvement in the Middle East will escalate as the President wraps himself in the flag to counter ‘unpatriotic’ Dems.
    2. News fatigue and mistrust will reach all-time highs. On the positive side, however, the demand for reliable information and fresh content will see people exploring beyond their news bubbles.
    3. Trump will be re-elected. Each one of the four realistic Democratic Presidential candidates, Joe Biden, Bernie Sanders, Elizabeth Warren and Pete Buttigieg has weaknesses that will be mercilessly exploited.
    4. The roll out of 5G will bring renewed scrutiny of Big Tech, with fears over data intrusion becoming a political issue.
    5. Global warming will continue to hog the headlines as fires and other disasters occur around the world. Here we may see a Republican pivot, with denials giving way to acknowledgement and the identification of opportunities, just as Putin’s Russia is looking ‘to use the advantages’ brought by climate change.[viii] Notably, Trump has recently acknowledged that climate change is no hoax.[ix] Watch this space.

  • ‘Wild Law’ is the Path of Natural Justice

    Man-made climate change is as good as a fact, but the consequences are uncertain in any specific location. Indeed, the island of Ireland could actually be more hospitable to human habitation under certain scenarios: drier and hotter summers are predicted, albeit with an increased likelihood of storm events; higher atmospheric CO2-levels could also increase crop yields.[i] Our rising emissions could have greater impacts elsewhere.

    Mitigation strategies may also have adverse side effects. Witness the expansion of sitka spruce plantations across Ireland, which acidify soils and strangle biodiversity,[ii] in pursuit of an improved carbon balance sheet permitting increases in dairy production. There are also question marks around the impacts of wind farms, especially those sited on blanket peat[iii], requiring hundreds of tonnes of concrete in construction, and disrupting the flightpaths of birds. If this energy is devoted to a new generation of electrified autonomous vehicles, rather than communal transport, it will be in vain.

    Climate change opportunism includes the distortion of supermarket shelves being stacked with organic products wrapped in plastic and flown halfway around the world. It is most obvious in the greenwashing of the agricultural sector,[iv] which consistently argues that Irish livestock’s lower emissions profile justifies expansion – as beef and dairy would only be produced elsewhere with higher emissions. Thankfully, the ‘our coal smokes less than their coal’ argument is more easily dismissed as data from the United Nations Food and Agriculture Organisation (FAO), analysed by An Taisce, shows that Ireland is, in actual fact, the most carbon-intensive beef producer in Europe, and ranks third on emissions from its dairy sector.[v] Most importantly, however, narrowing the environmental agenda to climate change alone obscures the equally pressing consideration of the Sixth Extinction, the unarguable reality of which is apparent in Ireland.

    With this in mind, Is it possible that interested parties could assert rights, already implied by the Irish Constitution, to protect Irish nature itself? Could spiralling emissions then be reduced alongside meaningful biodiversity-gains? Such an argument would build on a foundation of Natural Law, a school of thought embedded in the language and historic interpretation of the Irish Constitution. It can be traced to Classical antiquity, as Sophocles’s Antigone puts it: ‘the unwritten and unfailing statutes of heaven’, beyond the temporary, and occasionally illegitimate, laws of any state.

    During the Middle Ages, especially through Thomas Aquinas, ‘pagan’ Classical arguments were adopted by the Roman Catholic Church. In more recent times these became associated with a toxic and myopic focus on human sexuality, especially women’s bodies. Natural Law still transmits, however, compelling arguments for a universal justice beyond, and above, positive law, informed by dialectic, rather than Christian Revelation as is widely assumed.

    The jurist and former President of the High Court, Declan Costello wrote: ‘It has more than once been judicially observed that it can clearly be inferred that the [Irish] Constitution rejects legal positivism as a basis for the protection of fundamental rights and suggests instead a theory of natural law from which those rights can be derived.’[vi] Thus, from the 1960s, Natural Law interpretations ascribed a host of ‘Unenumerated Rights’[vii] to all citizens, including rights to bodily integrity, work, marry, privacy in marital relations, and free movement within the State. These rights are not explicitly identified in the Irish Constitution but are considered intrinsic to the human condition, flowing in particular from a generalised protection of personal rights under Article 40.3. With the Sixth Extinction now upon us, there is an urgent need for Natural Law to be extended to imply an Unenumerated Rights of other species to exist, along with ourselves.

    For this to occur, however, the Court must overcome a contemporary moral relativism, and aversion to decisive ethical responses. No doubt truth is a shifting target, and any single account is insufficient, but faith in our capacity to settle ethical arguments at a given point in time needs to be restored. As Aristotle – whose influence on Aquinas’s Natural Law theory was immense – pointed out:

    The theorizing of truth is in one sense difficult, in another easy. This is shown by the fact that whereas no one person can obtain an adequate grasp of it, we cannot all fail in the attempt; each thinker makes some statement about the natural world and as an individual contributes little or nothing to the inquiry; but a combination of all conjectures results in something considerable.[viii]

    Post-modernists will argue otherwise, but an outlook of ambient confusion is an admission of failure. Holes can be picked in any argument, but the argument as a whole – “a combination of all conjectures” – may stand. One cannot propose anything meaningful without the conviction of arriving at “something considerable” –  an elusive truth. A capacity to determine justice requires we overcome a ponderous Post-Truth incoherence.

    A contemporary philosopher Alasdair MacIntyre sees in the dialectic process, ‘the movement from thesis to thesis as a movement towards a kind of logos which will disclose how things are, not relative to some point of view, but as such’. Contemporary environmental challenges require new logical departures, disclosing “how things are”, “as such.”  Natural Law theory should encompass an Earth Jurisprudence. Then our laws may confront the reality of an oversized human population radically out of balance with its environment, with Ireland presenting a difficult case.

    Currently, however, environmental laws are generally seen as a body of rules foisted on the populace, often in exchange for a subsidy, rather than practices adopted for the commonweal. Accordingly, Coyle and Morrow claim such regulations are seen ‘as a technical instrument of social goals and policies, rather than a body of principles aiming at the articulation of a concept of justice and the good life.’[ix] This can partly be attributed to the prior failure of Natural Law theorists to identify inherent rights in other species.

    In contrast, the sanctity of human property rights have been vigorously upheld. Early modern theorists, drawing more on Christian revelation than reason, assumed rights of virtually unrestrained possession, along with dominion over all wild creatures therein. The seventeenth century Dutch jurist Hugo Grotius described this as ‘a grant which was renewed on the restoration of the world after the deluge’. To deprive any owner of this would, he said, be ‘an act of injustice.’[x] Importantly, however, up to that point there had been little necessity to assert the rights of wild animals, even in Europe, as humans were living in relative harmony with nature, or at least allowing other species to survive. According to Tim Flannery: ‘after the last muskox died in what is now Sweden about 9,000 years ago, the European mainland did not lose another species until the seventeenth century.’[xi]

    Since then the picture has changed dramatically across the world with sixty percent of wild animals wiped out since 1970 alone.[xii] Coyle and Morrow affirm: ‘The very agricultural practices which were held out as a moral necessity by the natural rights theorists can, it seems, create untold environmental damage.’ Given the scale of ecological damage that has ensued – associated with European colonisation of the globe – they argue that ‘the ethical assumptions of the seventeenth century conception of property cannot survive in such circumstances.’[xiii] The accumulating impacts on our planet of over seven billion human beings, living longer than ever, enjoins alternative approaches to land ownership. As Coyle and Morrow put it: ‘If human agriculture was ever in harmony with nature it certainly is not any longer and the sanctity of individual ownership must be restrained. Duties must join rights.’[xiv]

    Natural Law is an ongoing, truth-seeking dialectical process with the aim of disclosing, “how things are, not relative to some point of view, but as such.” If Natural Law is to have continued relevance it must adapt to current conditions. A re-imagining of Natural Law is evident in the field of Earth Jurisprudence, or Wild Law, a term coined by Cormac Cullinan to refer to human laws that are consistent with Earth Jurisprudence.[xv] According to one of its inspirators, Thomas Berry: ‘The Universe is not a collection of objects but a communion of subjects and every member of the Earth Community has three inherent rights: the right to be, to habitat, and to fulfil its role in the ever-renewing processes of the Earth community.’[xvi] These rights ought, logically and morally, to be incorporated into Irish law.

    But how can these aspirations be given tangible legal form? In a seminal 1972 article ‘Should Trees Have Standing?’[xvii] Christopher D. Stone explores how Wild Law might apply. He argues that natural objects could have legal standing by analogy with companies, states, infants, incompetents, municipalities or even universities. Thus, a court appoints a trustee when a corporation displays incompetence. He writes:

    On a parity of reasoning, we should have a system in which, when a friend of a natural object perceives it to be endangered, he can apply to a court for the creation of a guardianship … The guardian would urge before the court injuries not presently cognizable – the death of eagles and inedible crabs, the suffering of sea lions, the loss from the face of the earth of species of commercially valueless birds, the disappearance of wilderness areas.

    He also draws an analogy with the law of patents and copyright:

    I am proposing that we do the same with eagles and wilderness areas as we do with copyrighted works, patented inventions and privacy: make the violation of rights in them to be a cost by declaring the piracy of them to be the invasion of a property interest.

    Furthermore, he suggests this could lead to modifications in our representative democracies:

    I am suggesting that there is nothing unthinkable about, and there might on balance even be a prevailing case to be made for an electoral appointment that made some systematic effort to allow for the representative “rights” of non-human life.

    Stone envisages changes in our legal culture informing wider social norms, as, ‘a society that spoke of the “legal rights of the environment” would be inclined to legislate more environment-protecting rules by formal enactment.’

    Intriguingly, he also speculates, ‘What is needed is a myth that can fit our growing body of knowledge of geophysics, biology and the cosmos’, proposing ‘that we may come to regard the Earth, as some have suggested, as one organism of which mankind is a functional part’. Similarly, Coyle and Morrow argue: ‘The problem is that meaningful change responding to environmental and social imperatives will require a true paradigm shift in how we regard our relationship with the world of which we form a part.’

    A transformation in our legal relationship with the natural world requires the participation of other fields. It was Percy Bysshe Shelley who famously described the poets as the ‘unacknowledged legislators of the world.’ The philosopher Timothy Morton makes the provocative claim that putting ‘something called Nature on a pedestal and admiring it from afar does for the environment what patriarchy did for the figure of women.’[xviii] Perhaps W.B. Yeats’s identification of Irish nature with a ‘glimmering girl’, ‘with apple blossoms in her hair’ distracts from an ongoing exploitative relationship, linked to our colonial inheritance. Indeed, rather than celebrating a patriarch ‘Digging’ for turf, as in Seamus Heaney’s poem by that name did, new accounts might draw inspiration from an often-overlooked visionary poet of the early twentieth-century Irish Revival, Eva Gore-Booth. She gave up the wealth and privilege of her aristocratic background to devote herself to the poor. Gore-Booth also recognises the right of all creatures to exist on the land, notwithstanding human ownership in her 1906 poem ‘The Landlord’

    O the bracken waves and the foxgloves flame,
    And none of them ever has heard your name –
    Near and dear is the curlew’s cry,
    You are merely a stranger passing by.
    [xix]

    Hearteningly, all around the world, from Ecuador to New Zealand, conceptions of Earth Jurisprudence, Wild Law or Pachamama are actually taking route. For example, Germany’s constitution makes protection of ‘the foundations of nature and animals’ a national imperative, applicable to government agencies, the legislature and the judiciary. The provision has been cited in over seven hundred cases. Moreover, echoing Christopher D. Stone, Oliver A. Houck points out this ‘does not include the more numerous acts of compliance that drew no litigation at all.’[xx]

    Meanwhile in Ireland species loss continues apace. Liam Lysaght recently records: ‘of the 3,000 species that have undergone a red list conservation assessment, one in every four species is threatened with extinction here.’[xxi] Of particular concern is the continued exploitation of peat bogs for fossil fuel extraction – where considerations of nature conservation align precisely with keeping fossil fuels, and embedded methane, in the ground – as well as the impacts of grazing ruminants.

    Unfortunately, existing environmental legislation, including the EU’s Habitats Directive, is failing to protect endangered species adequately, including the iconic curlew, which is now on the red list. This can partly be attributed to a lack of enforcement, but also, as we observed, such laws are currently considered an encumbrance on property owners, and not a scheme of protection for a common inheritance. So how do we spare what remains of Irish nature from the ravages of human exploitation?

    A constitutional amendment enshrining nature rights, similar to that operating in Germany, should be the long-term goal. But this will take time to bring to fruition, especially as mainstream media only falteringly highlights extinction threats, and none of the main political parties prioritise protection of biodiversity.

    I propose the alternative of a test case, applying Thomas Berry’s tripartite rights to a particular native species; proposing, for example, the curlew has a right to be, to habitat and to reproduce, alongside humans, based on a Natural Law interpretation of the Irish Constitution – as a previously Unenumerated Right. It seems crucial that such rights are ‘discovered’ sooner rather than later before further, irreversible, losses occur.

    The Court could certainly injunct particular activities to protect species under threat, or prohibit certain classes of herbicides or insecticides outright, or even declare particular lands under private ownership as protected habitats. This will require expert witness from recognised authorities to distinguish competing rights of native, invasive and naturalized species. Property owners should be compensated for any loss, but under the Irish Constitution all rights, including that to property, are subject to the common good, which is served by preventing extinctions.

    The allocation of reserves and prohibition on the use of certain chemicals would be a proportionate appropriation by the Judiciary of the powers of the Legislature and Executive branches, in circumstances where there has been a serious dereliction of duty. The Sixth Extinction is an emergency happening before our eyes with recognisable victims, unlike the unpredictable devastation that climate change is wreaking.

    Cattle and sheep farmers can find new roles as landscape guardians. Re-wilding may begin with marginal lands, where farming is already uneconomic, while better land currently under pasture can be converted to tillage in order to accelerate what a recent article in The Lancet has referred to as the ‘Great Food Transformation.’[xxii]

    Eventually, beyond legal prescriptions, habitat reclamation can endear the population to the landscape, and reform destructive behaviours. In developing our appreciation of the soft sounds and sweet aromas in nature we may consider reducing dependence on noisy, polluting motor cars. Greater biodiversity also offers scope for judicious harvesting of foodstuffs, building materials and fuel. The tragedy of the loss of other species is almost impossible to convey.

    Many of us wish to see our laws go further: putting an end to the perverse subsidy regime that only benefits the Beef Barons; or dignifying all animals with a decent life, in the wild. For the moment, however, our best legal argument is to assert the rights of all resident Irish species, living in ecological balance, simply to exist. Reduced emissions will be a happy by-product of biodiversity-gain, raising environmental awareness to a point where destructive behaviours are recognised, and changed. In beginning to liberate the natural world from human dominion let us recall the small victories won in the battle against human slavery along the road to the great milestones. Wild Law can emerge incrementally in Ireland through our existing constitutional framework.
